In this case , Mr Gribble made what seemed like a reasonable decision, to represent himself in court, using artificial intelligence to help him in presenting his case. When digital confidence became a courtroom catastrophe AI didn't just help Mr Gribble organise his thoughts or explain legal concepts, it went too far and created an entire legal argument which lacked foundation and legal authority. Most significantly, AI created a completely fake case and attributed it to Judge Gibson, the very same judge who heard Mr Gribble's defamation claim. AI didn't stop there though. It generated additional fake cases from other courts and invented legal principles that sounded authoritative to a non-lawyer, but in fact had no basis in actual law. The result was that AI created convincing-looking legal arguments that Mr Gribble cited as establishing his case, complete with specific court references and judicial reasoning that never existed. When Judge Gibson reviewed Mr Gribble's submissions to the court, something immediately caught his attention. He recognised that Mr Gribble was citing a court decision attributed to the judge in support of his case that did not exist. Swearing a false affidavit can constitute perjury and carries with it significant penalties. While the AI fabricated cases were the most dramatic failure for Mr Gribble, they weren't his only problem. Mr Gribble’s legal pleadings (being those documents he filed with the court) revealed his fundamental misunderstanding of defamation law, highlighting why legal advice matters for business disputes, especially in highly technical areas of law. For defamation cases involving spoken words, courts require the exact word for word conversation, not summaries or educated guesses of what might have been said. In this case, Mr Gribble provided only vague approximations, essentially admitting he was "guessing at words that might have been spoken" during crucial phone conversations. His court documents were also repetitive and confusing, pleading the same facts multiple times in slightly different ways while failing to properly explain how the alleged defamatory statements were republished to others which is a crucial element for establishing damages in a defamation case. The consequences of using AI as a substitute for a qualified lawyer Judge Gibson struck out Mr Gribble's entire case, meaning months of work and considerable amounts of money were wasted by both parties and the court. Mr Gribble was ordered to pay Essential Energy's legal costs for the court hearing. While the judge granted leave for Mr Gribble to try again, meaning that he could re-file his proceedings, it came with a stern warning that this was likely his "last chance," with the threat of automatic dismissal if he failed to properly plead his case again. For a small electrical design business already dealing with alleged reputational damage, these additional costs and the public nature of the court's criticism were far from ideal. Not only had Mr Gribble failed to achieve his aim of vindicating his reputation, his AI-assisted legal strategy had severe financial consequences for his business. And if you think you can get AI to draft your terms and conditions, contracts or letters of demand and have your lawyer rubber stamp it, think again. By doing this, you’re actually creating more work for your lawyer, and more costs for yourself. Your lawyer is bound by strict ethical obligations and would need to review the document thoroughly in any event and inevitably make corrections to it to produce output that is legally accurate. Successful small businesses build their legal literacy and cultivate professional relationships before crises emerge. You can do this by: Attending business legal workshops and joining industry associations with legal resources. Conducting regular reviews of your business to identify emerging legal issues early. Building peer networks where other business owners share legal experiences and referrals. Establishing relationships with lawyers specialising in commercial law and your specific industry.
